Meth found after woman arrested following altercation with police

A Galesburg woman faces felony battery and drug charges after an incident over the weekend.

37-year-old Misty D. Burns made a video appearance in Knox County Circuit Court with Judge Raymond Cavanaugh. Bond was set at $5,000 and the Public Defender’s office was appointed.

Burns is charged with a Class 2 Felony of Aggravated Battery to a Peace Officer, which if convicted could land her in the Department of Corrections for 3 to 7 years. Additionally she faces Class 3 felonies of Aggravated Battery a Possession Methamphetamine less than five grams. Both of those charges carry a 2 to 5 year sentence.

According to a Galesburg Police report, officers were dispatched to Monkey Business at 35 East Simmons for a disturbance Sunday morning around 1:10. At the business, bar personnel pointed out Burns specifically. While they told police that Burns was not responsible for causing the disturbance, she had been removed from the bar for being too intoxicated.

While being questions she allegedly refused to identify herself to police. She eventually pushed an officer which led to her arrest. During the altercation she struggled with police and was eventually brought to the ground.

After being detained, officers attempted to escort Burns to a patrol car, but she allegedly refused to comply and laid on the ground. When officers tried to get her up, she allegedly kicked one in the face.

She was taken to Cottage Hospital where she still fought with police. Hospital staff attempted to assist, but she kicked an RN in the chest and continued to kick at anyone who came near her. She was taken into the hospital for evaluation, but reports indicate that officers still had trouble controlling her.

“Because of her violent and erratic behavior, the hospital sedated Burns,” the police report said. During the evaluation, officers searched through her purse to which they found 1.5 grams of a white crystal substance that later field tested positive for methamphetamine.

As a condition of her bail, Judge Cavanaugh instructed Burns to consume no drugs or alcohol and to not set foot into a bar.

A preliminary hearing was scheduled for December 3rd.
