Galesburg Election Commission files suit against Knox County Treasurer

The Galesburg Election Commission filed a civil lawsuit Monday against Knox County and Treasurer Robin Davis.The suit seeks a declaratory judgement saying that an “actual controversy exists between the plaintiff and defendants.”

It also asks the court to find Davis in civil contempt of court for failing to honor a warrant issued by 9th Circuit Chief Judge David L. Vancil Jr.

State law lays out that the Galesburg Board of Elections sets the salary for the Commission’s Executive Director, which for Galesburg is Lisa Watson, and for the Assistant Director, which is Angela Jenkins.

The suit says that the Election Commissioners approved a 12 percent salary increase for the Executive Director and a 5 percent increase of the Assistant in May 2017 and that was communicated to the Knox County Board in June 2017.

It goes on to say that Davis never paid Watson and Jenkins at their new increased rate even though they were to take effect on Dec. 1, 2017.

Judge Vancil issued a warrant in February for Davis to pay the two election directors the new rate, a bi-weekly sum of $1539.81 for Watson and $1,036.93 for Jenkins, but she continued paying what she had previously.

The suit argues that Davis is in neglect of her duties and should have to pay between $50 and $1,000, half to the county and half to the GEC along with a “reasonable attorney fee” upon a contempt finding.
